Disclaimer

Client understands that the private and group instruction offered in the sessions conducted by HTS Holdings Limited (trading as Flex) (the “Flex Session(s)”) is limited to the instruction of Pilates, Yoga, Xtend Barre®, AntiGravity® Aerial Fitness, FLEXtreme Fitness,  ballet, dance and such other types of fitness instruction as HTS Holdings Limited may from time to time offer;

Client understands that the Flex Sessions will impose physical demands on them and that even with clear instruction in participation in Flex Sessions involves the risk of injury;

Client voluntarily accept the risk of injury and agree to and hereby release HTS Holdings Limited, its proprietors, management, employees, contractors and instructors from any liability whatsoever for any injury, loss or damage whatsoever suffered by Client and howsoever sustained (including, without limitation, personal bodily, mental injury or economic loss), whether arising under the express or implied terms of any agreement whether direct or indirect and including consequential losses, arising out of any of the activities of this Flex studio or resulting from Client attendance, participation in and receiving instruction at any Flex Session or in any way whatsoever which does not arise from any negligent act or omission of HTS Holdings Limited, its proprietors, management, employees, contractors or instructors.

Client understands that it is the responsibility of the Client to consult a physician regarding the ability to participate in a Flex Session before coming to any HTS Holdings Limited premises or attending a Flex Session:

Client attest that they have no physical, psychological, medical or emotional condition that would prevent the Client from safe participation in a Flex Session and that may have fully declared all such conditions or any issues which may affect the ability to exercise safely in the above section

2.) Medical history;

Client agrees that this agreement shall be governed by the laws of Hong Kong Special Administrative Region and hereby submits to the non-exclusive jurisdiction of the courts of the HKSAR with respect to all matters relating to this agreement;

Client understands that there is a cancellation policy in effect at this studio. In fairness to other clients waiting for (appointment) slots, a minimum of 24-hours notice is required for private sessions and 6 hours notice is required for group/allegro classes, in order to avoid a late cancellation charge. Client will be charged the full class/session rate for a late cancellation or ‘no-show’, except in the event of an emergency.

Client has read this agreement and fully understands the content and meaning of all of the above terms and conditions.
